The Broken Legal System

The legal system is such a mess that it just makes you scream.

The legal system should be a pillar of democracy, providing justice and order for all.

But it’s an increasingly complicated and expensive environment, benefitting only those who can afford it.

The toll our broken system is taking on society is mounting, as people grapple with an elusive and wasteful system.

Our income and estate tax system is broken. It has high statutory rates with a Swiss cheese of exemptions, immense cost, unfairness and distortion. Former President Trump’s taxes are Exhibit A, no longer making headlines because we learned that he simply aggressively exploits the complex rules and deductions that Congress offers to wealthy politically connected real-estate investors.

It’s All Just a Big Mess

The legal system is a web of intricate laws, clauses, and precedents. It is impossible for the average person to navigate all this nonsense without professional help.

This complexity disproportionately affects those who cannot afford skilled lawyers, putting them at an inherent disadvantage.

Protracted trials and appeals drag on endlessly, as lawyers debate minutiae, prolonging the already torturous process for those involved and further draining resources from an already-strained system.

Insane Costs

The astronomical cost of obtaining legal representation is no good.

Only the wealthy really have access to the law.

Skilled lawyers command top-dollar fees, making them inaccessible to the common person.

Despite the existence of legal aid programs, many people struggle to access the legal system due to a lack of resources or information. People with limited financial means must either rely on low-quality, overworked public defenders or go without legal counsel altogether.

This imbalance creates an unjust system where wealthier individuals receive superior legal representation and results, while poorer defendants have to fend for themselves.

So Much Wastefulness

The legal system’s primary function is to waste time, money, and resources. Pretrial hearings, continuances, and all the other nonsense procedural issues increase the time spent in court and drive up the financial burden on defendants and taxpayers alike.

Court systems are insanely congested. Around the country, we have extensive wait times for those hoping for relief or justice. The glacial pace of the system prolongs suffering for victims and families alike, as they wait for closure and restitution, leaving emotional wounds to fester. All the while lawyers add to their billable hours.

Corporate Law

Many areas of corporate law are harmful to the general public and counter to societal progress.

Corporate law prioritizes the interests of shareholders over other stakeholders including customers, employees, or the environment. Most companies make decisions that prioritize short-term profits over long-term sustainability or the well-being of workers. Companies engage in cost-cutting measures such as layoffs or outsourcing to boost profits, even if these measures have negative impacts on workers, the community, the country, and even the long-term viability of the company itself.

Corporate law enables large corporations to avoid accountability for their actions. This can occur through complex legal structures that allow companies to shield themselves from liability or through lobbying efforts that influence regulatory policy in their favor. This can lead to situations where companies engage in harmful practices, such as environmental pollution or labor exploitation, without facing meaningful consequences.

The Law Written By And For The Wealthy

Corporate law is overly complex and difficult to navigate, particularly for smaller businesses or individuals. Lobbyists push tax breaks and subsidies only a team of lawyers can take advantage of.

The huge corporations pay lawyers and politicians to write the law to favor them, while smaller companies that can’t afford lawyers and lobbyists are left behind, giving ever more power to the wealthy.

Our legal system encourages and incentivizes corporations to create barriers to entry and limit competition, particularly in industries where large corporations hold significant power.

Intellectual Property

Many aspects of intellectual property law are detrimental to a healthy society.

It stifles innovation and competition. For example, patent trolls, or companies that acquire patents primarily for the purpose of suing other companies for infringement, can impede innovation by discouraging companies from pursuing new ideas. The patent system is overly broad and allows for patents to be granted for inventions that are not truly innovative, limiting competition and stifling progress.

There is a lack of access to important resources, particularly in developing countries. Patents on essential medicines, for example, can make them prohibitively expensive for many people, particularly in regions with few alternative treatments available. Copyright law limits access to important educational resources and restricts the spread of information and ideas.

Overly broad copyright laws limit the ability of artists and creators to build upon existing works and restrict the spread of transformative works such as fan fiction or remixes.

Intellectual property law does have a role to play in incentivizing innovation and protecting the rights of creators and innovators. But our broken legal system ensures that doesn’t happen.

The Ripple Effects

These problems within the legal system impact nearly every area of society, from criminal justice to family law.

The excessive costs and complexities of the system lead to wrongful convictions, unjust settlements, or even wrongful imprisonment for those who cannot afford proper representation, further exacerbating social inequality.

There is no accountability at the upper echelon of society, while the poor are hit with endless fees.

Additionally, family law disputes such as custody battles and divorces can become unnecessarily long, expensive, and emotionally draining due to legal intricacies and fees, leaving families devastated and finances depleted.

Just a Fancy Word for Confusion

The legal system, intended to serve all members of society justly and equally, has devolved into a playground for the wealthy and well-connected.

With its complexity, high cost, and wastefulness, individuals from lower income brackets as well as smaller businesses struggle to find justice, often left with no choice but to accept unfavorable outcomes.

We must address these imbalances to restore faith in our justice system, implement reforms that simplify the process, increase access to affordable legal representation, and reduce the wasteful resources that plague the system.
